TERMS AND CONDITIONS OF SALE

These Trading Terms govern the sale and delivery of all goods and services by Curate Sydney (ABN 78131545859) ("Curate Sydney," "we," "us") to our customers.

Definitions

  • “Customer” and “you” refers to the buyer (or any person acting on behalf of and with the authority of the buyer) as described in any quotation, order confirmation, or other form provided by Curate Sydney.

Price

  1. You must pay for all goods at the time of submitting an order (“Order”) with Curate Sydney. Accepted payment methods include Visa, MasterCard, Amex, Afterpay, or PayPal.

  2. Goods are not secured until payment is received in full.

  3. All Orders placed through our website https://www.curatesydney.com.au/ (“Site”) are subject to confirmation and acceptance by Curate Sydney. We will email you with confirmation of your Order.

  4. The price of the Goods is the amount shown on the Site and is inclusive of GST, except where stated otherwise.

  5. Late payments will incur interest compounded monthly at a rate of 10%.

  6. Curate Sydney reserves the right to adjust prices for Goods due to supplier cost increases or changes in law.

  7. Prices exclude delivery, packing, loading, and installation costs.

  8. All prices are subject to alteration at any time. If you disagree with an increase, you may cancel the Order within seven (7) days of notification.

  9. All quotations are indicative, valid for 10 days, and items are not secured until payment is received.

Risk and Title

  1. Risk in the Goods passes to you upon collection from our warehouse or delivery to your premises.

  2. Title remains with Curate Sydney until full payment has been made.

Delivery, Claims, Returns & Cancellations

  1. Delivery will be made to your specified address as per our Shipping and Delivery policy available on the Site.

  2. If Goods are not collected after 7 days of the nominated delivery date, you will incur storage costs.

  3. We offer pickup from our warehouse; please ensure that you inspect all goods upon collection.

  4. Once delivered, Goods cannot be returned unless defective. Claims must be submitted via email, in writing within 24 hours of receipt, including photos and a description of the issue.

  5. You may not return Goods due to change of mind.

  6. We reserve the right to refuse returns of Goods not in “as new” condition due to misuse or damage caused by you.

  7. Custom orders cannot be cancelled. By placing a custom order, you agree to these terms.

Custom Orders

  1. Payment in full is required to place a custom order.

  2. Lead times for custom orders are approximate and vary from item to item, depending on fabric, trim, availability, etc. This excludes any delays beyond our control.

  3. Natural materials may vary; returns or cancellations due to material variations are not accepted.

Errors, Inaccuracies, and Omissions

  1. While we strive for accuracy, we are not responsible for any errors or inaccuracies on our Site and reserve the right to correct them at any time.

Force Majeure

  1. Curate Sydney is not liable for any delays or failures due to events beyond our control.

Prohibition on Resale

  1. You may not purchase Goods for resale without our prior written consent.

Usage of the Site

  1. The Site is protected by SSL encryption to ensure secure transactions.

  2. Curate Sydney does not store credit card information.

  3. You agree to use the Site for lawful purposes only.

General

  1. If any provision of these Terms is unenforceable, the remaining provisions remain in effect.

  2. These Terms constitute the entire agreement regarding the supply of Goods.

Governing Law

  1. These Terms are governed by the laws of New South Wales, Australia.

Notices

  1. Any required notice may be given to the address specified in your Order or via electronic means.

Limitation of Liability

  1. To the extent permitted by law, we exclude liability for indirect damages or losses.

  2. Warranty is void if Goods are modified or repaired by an unauthorized party.

Intellectual Property

  1. All intellectual property related to our products and designs is owned by Curate Sydney. You may not use this intellectual property without permission.

Fraud

  1. Curate Sydney is not liable for any purchases made with fraudulent or stolen cards.
